REGULATING THE EUROPEAN INTERNAL MARKET

In class, we will ﬁrst identify the different steps necessary to achieve the organization and the functioning of the internal market, which is the highest level of market organization. We will then identify the obstacles to free movement and conduct a contextual and functional analysis of the prohibition against obstacles and discrimination in the various policies of the Member States as one of the core legal disciplines which inform the law of the internal market place. The class will focus in particular on the rules governing the free movement in the European Union. Therefore, the free movement of goods, services, persons will be our main focus. We shall also pay attention to the provision of the Treaty which allow the Union legislator to enact regulatory measures aimed at the approximation of national provisions which have as their object the establishment and the functioning of the internal market. Finally, we shall also devote some time to the free movement of European citizens, a noneconomic freedom which is closely linked to the four freedoms. Prerequisite : None. Pedagogical Format : Lecture alone Course validation : Students will be graded according to the ECTS system used at Sciences Po. The ﬁnal exam is a 3/4-hour long open-book exam and will count for 50% of the ﬁnal grade. A mid-term exam, counting for 50% of the ﬁnal grade, will be organized during the semester. Class participation may allow obtaining a higher grade. Workload : Every course will necessitate the reading of at least one document in order to follow more easily the course. This could be a Directive, a Regulation or a Communication of the Commission. Pedagogical Method : During the classes we will keep lecturing to the minimum and engage in discussion with the students. Therefore, for each class you must read the assignments speciﬁc to the topic of the class beforehand and be able to discuss them in depth. This preparation is necessary to follow classes proactively. The class will focus mainly on legal, but if necessary also on economic and political issues.
